The Covenants covering Tallow Creek Subdivision are provided below in two formats:

Covenants
Summary
- Purchase
of a home in Tallow Creek includes membership in the Homeowners' Association.
- Membership
provides enjoyment of all Common Spaces, which we all own together through the Association, and protection under the rules
of the Association.
- Annual dues, assessed to cover the costs of operation
of the Association and the Common Spaces, and professional services as required, are currently set at $250.00 per year, per
lot.
- The Association is governed by a Board of Directors, elected by the homeowners.
Each home has one vote in all elections and other votes.
- The Board
includes an Architectural Control Committee, whose purpose is to review and approve any and all improvements, changes, additions,
etc. to the exterior of a home or to its grounds.
- The Covenants,
which apply to each and every home in Tallow Creek, contain rules and restrictions enforceable equally on all homeowners.
- These Covenants are legally binding on all homeowners in Tallow Creek, and are
enforceable through fines, sanctions, and legal action where required. Their main points are:
- Homes may be used only as single family residences.
- Noxious,
illegal, or offensive activities are prohibited.
- Boarding or raising
of livestock, poultry, or farm animals is prohibited.
- Pets (dogs, cats,
caged birds) are allowed up to an aggregate of 3 per home.
- Pets may
not be allowed to run free; they must be leashed, caged, or fenced.
- Pets
that constitute a nuisance to neighbors will be ordered removed.
- Burning
of trash is not allowed, except for leaves & twigs, which is discouraged for safety.
- Accumulations of trash, litter, or building materials in view are not allowed.
- Vehicles of any kind (automobiles, boats, RV's, trailers, etc.) may not be stored on any lot, except
inside garages or those that do not exceed 8 feet in height and are kept behind an approved fence.
- Motorbikes, motorcycles, or other 2, 3,
or 4-wheeled motorized recreational vehicles are prohibited. Motorcycles used for normal transportation are exempted.
- Parking on the street is not allowed, except for short-term visitors who
do not obstruct the street.
- No
junk vehicle, commercial vehicle, boat, trailer, camp truck, motor homes, mobile home, house trailer, tractor, bus, modular
home, geodesic dome, or home designed for movement on wheels, or other machinery or equipment of any kind or character shall
be kept or maintained upon the Property, nor (except for emergencies) shall the repair or extraordinary maintenance of automobiles
or other vehicles performed on any Lot.
- Trash and garbage containers must be stored out of
sight, except for pickup.
- No lot or home may be subdivided.
- No trees may be removed without permission.
- Satellite
dishes are allowed only in positions as approved by the Architectural Control Committee. This is interpreted
as being on the rear of the house, out of sight of the street, unless such locations cannot receive a proper signal because
of obstructions.
- Temporary structures will not be allowed, except those used
during construction.
- Signs advertising commercial businesses are not
allowed (standard "For Sale" signs are allowed).
- The Servitude
for Utilities, across the front of every lot, may not be compromised.
- Dwellings
and other structures may not be allowed to fall into disrepair.
- Lawns
and plantings must be kept in neat order.
- Fences require prior approval,
and must conform to the construction, location, and appearance norms as established.
- Sheds, gazebos, and other outbuildings require prior approval, and must conform to the construction,
size, location, and appearance norms as established.
- Discharge of firearms
is strictly prohibited.
- Outdoor loudspeakers or other sound or music
devices are strictly prohibited. The current interpretation of this prohibition is that such outdoor speakers will be
allowed, so long as their use does not constitute a nuisance to the neighborhood.
- The established drainage patterns of lots may not be disrupted.
- No person is allowed to swim, wade, or otherwise enter the Ponds.
