TALLOW CREEK HOMEOWNERS’ ASSOCIATION

There was an introduction by Robert Soule.

Treasurer Kathleen Morris gave a financial report           
- We are currently 15K under budget.           
- Twenty (20) liens have been filed.  Of those, one was reported as a bankruptcy and one is in repossession so there are currently 18 outstanding liens.           
- Twenty-five (25) homeowners have not paid late fees. 
.
Joseph Rupp gave his report for the architectural committee.       
- We have received help through court enforcement on several violations, particularly untended lots.           
- Pink door hangers have been made and some have been distributed.  If you receive one, please act on it immediately.           
- Tallow Creek is considering the assistance of a Justice of the Peace in order to seek swift resolution on violations.           
- The speed limit on the roads is 25 mph and this was developed by the MUTCD standards, which rates all roadways.  According to this system, the roads cannot be rated less than 25 mph as 98% of the people who drive on them would then be speeding and the conditions do not warrant it.

Kevin Kullivan issued his report for the events committee.          
-  There was a garage sale held on October 15th.  Semi-annual garage sales will be held on the first Saturday of April and October.  Notice of the event will be given to homeowners through the website and newsletter.           
-  Different video security systems have been looked at an estimates have been given but the estimates have been vague.  TCHOA is looking for a system that has the potential for additional add on in the future as the community grows.  We are also looking for a package deal that includes installation and maintenance.  No decisions have yet been made on which system to install.  Regardless the cost of association dues will not go up because of the security camera.

Robert Soule introduced TCHOA attorney Anthony Maska to update us on the litigation with Lonesome Development and Tallow Creek, LLC.          
-  Henning acting for Lonesome Development amended the bylaws and donated the greenspaces (including the ponds) to the association.  He did not have the authority to do so. We have filed suit accordingly.           
- Included in the suit is a financial reward in the form of unpaid HOA dues on lots held by Lonesome Development.           
-  Tallow Creek LLC (a subsidiary of Southern Homes) was added to the lawsuit for unpaid dues.  They responded that Lonesome had waived the dues but our argument is that Lonesome did not have the authority to do so.

Robert Soule informed us of additional new business.         
- Goodman A/C will allow claims on a case by case basis.  Two preferred contractors who are aware of the Goodman warranty issued will be posted on the website.  The coils have a ten year warranty.           
- Tallow Creek HOA newsletter has been completed and distributed.           
-  The proposal on the sale of the design center to TCHOA has fallen through due to the litigation between the association and Southern Homes.           
- The disputed Seeger Road will be surveyed to determine the exact area of the boundary between the greenspaces and private property.  Once that has been done, signs will be posted and maps will be added to the website.             
- Marking and picture taking have been done by the parish for street maintained purposes.  They will now find a subcontractor to come in and do the work on which sites they determine need fixing.           
- Additional police patrols of Tallow Creek subdivision have been request by the board to St Tammany Sheriff’s Department.

Kevin Kullivan detailed the Halloween security process.         
- There will be two patrols - one at J.J. and Tallow Creek to stop visitor traffic after 6pm and one that will be roaming.             
- Exemptions from the closure will be people who are elderly, small children, and the handicapped.           
- Two signs will be posted at the entry to the subdivision to notify people of the stop point.             
- Residents entering the subdivision between 6pm - 10pm will need to have their driver’s license, address, or a parking sticker.

Robert Soule read a statment as to why the board had come to the decision to close the neighborhood to traffic during Halloween evening. Discussion items included: 
-  Several members were unhappy with the closures on Halloween night as there were holding parties and felt that it unfairly unconvinced their guests without adding to the safety of the community.
- There were a few questions reqarding what ages of children in the cars could be in order for them to be allowed through the checkpont. It would be up to the officers discretion.

General Homeowners’ Meeting Minutes

Interim Association President Matthew Harris convened the meeting.  He explained that the board member who was supposed to take over as president had stepped down and that he would be filling in temporarily.  He also advised that those who had personal issues could contact the board via the information on the website.  Issues such as brown water, noisy neighbors, and animal control needed to be dealt with in the appropriate manner by contacting the parish government.

Robert Soule provided a financial report. 
    - We are currently $12k under budget, however we are awaiting attorney’s fees in the form of a retainer payment. 
    - There are currently 27 residents in default on their dues and/or legal fees.  This does not include Lonesome Development and Tallow Creek LLC.
    - TCHOA has opened a Small Business Money Market Account that yields a higher interest.
    - There are 25 residents that have been turned over to the attorney for non-payment of dues.  Processing will begin to attach liens to their property.

Robert Soule also provided an update on the lawsuit with Tim Henning/Lonesome Development.
    -  Henning amended the covenants without the permission or knowledge of the board or residents of TC.  He then donated and accepted the green spaces on our behalf.   
    -  TCHOA is currently suing Henning for this and unpaid dues and damages for landscaping. 
    -  Tallow Creek LLC was enjoined to the lawsuit for unpaid HOA dues on unimproved/improved lots from their purchase from Lonesome Development.
        -  Open letters have been sent to both Henning and Tallow Creek LLC.  There was no response from Henning.  We are currently awaiting return of Sheriff Service.
  - Matthew Harris announced TCHOA has been offered the purchase of the sales/design center for $45k. 
    -  There are additional questions regarding the agreement that Southern Homes had with the parish government about demolishing the building at the end of its commercial use.
         -  There are additional questions about what the residents of TCHOA would purpose the building for. 
    -  The estimated costs for running the build as is would be $13k per year.  To demo the build could cost the TCHOA an additional $12k. 
    -  A playground was brought up as a possible use but there are additional complications in that there is limited parking and the sold homes that already exist on that street. 
     
Kevin Kulivan proposed that the board would like to install security cameras at the front entrance.
    -  The response was overwhelmingly positive. 
    -  The system would be positioned on a camera pole just after the brick wall in front.  It would capture an image of the front of cars, including the driver and license plate entering the subdivision.  Homeowners could access the images from their home computers though the main stock would be kept in a secure location. 
    -  The first estimate received was approximately $2700.  Mr. Kulivan will obtain two more estimates and proceed with the best estimate.

Discussion items included:

-  We are currently looking for people who are interested in joining the board.  We have lost a member and are in need of someone who is willing to fill in as treasurer.
-  There was an alligator spotted in one of the ponds.  The Sheriff’s office was notified and though they have been attempting to catch it, they have yet to succeed.
-  There have been some improvements to the green spaces.  Sprinkler parts have been repaired, replaced, and are in the process of being updated.  Some azaleas were replaced.  A few dead trees were taken down in places where they were threatening homes.
-  All future changes to covenants will only be done will the approval and vote of the members of TCHOA.  Unfortunately, in the past and because of the way that the covenants were written, the enforcement of covenants were very vague.
-  Some residents have requested additional security detail for Halloween due to the heavy foot traffic and cars.  The board will continue to discuss options.
-  The idea of a Neighborhood Watch program was suggested.
-  A TCHOA newsletter is currently in the works. 
-  A recycling program is currently not available in St. Tammany Parish.  However, according to one of the residents YMCA accepts newspapers and Walmart accepts plastic bags.

The meeting was convened by Association President Joseph Rupp.  In his words he stated that the board had dealt with many issues during the last year.  He also stated to those assembled that if they had personal issues that could not be dealt with during the meeting that he would make a note of it and get back to them on a more personal basis.  

-  The first issue brought up was the brown water occurring in homes across the subdivision.  SELA (now Tammany Utilities) has been informed of the issue multiple times and by multiple homeowners.  At issue is that the water is full of manganese which is discoloring the water and damaging personal items.  Tammany Utilities has been flushing the sewer system which leads to temporary improvement but is not lasting.  The residents were encouraged to bring the subject up with Marty Dean who was expected to attend the meeting.

- The financial report was given by Treasurer Jim Martin.  Currently, Tallow Creek is projected to be under budget by $9000.  However, these funds are being held to insure, repair, and maintain the green spaces when and if they ever come into our possession. (Ownership is currently in dispute.)  There are nine (9) liens against various homes for unpaid association dues.

- Guest Tony Maska was recognized by Joseph Rupp.  Tony Maska is the attorney representing Tallow Creek HOA in the dispute over the green spaces with Lonesome Development.  He gave an overview of the situation with Lonesome Development.  That it is the position of TCHOA that the damage occurring to the ponds and subsequently the homes on the ponds is due to substandard construction of those ponds.  That TCHOA believes that the developer, Lonesome Development, is responsible to bring those ponds up to specification so that they may be donated to St Tammany Parish.  Mr. Maska further stated that the next step would be for all parties involved to schedule a mediation meeting for January of February to determine if a solution might be met without going to trial.  Mr. Maska was thanked for his time.

-  Sinkholes were the next item on the agenda.  There is a large sinkhole at the entry to the subdivision along Tallow Creek Drive.  Mr. Rupp has contacted John Smith at St Tammany Parish Dept of Engineering to let him know about the sink hole and the hazards that it is creating to the community.  Currently there are cones out and a small sign to mark off the area.  The question was brought up whether or not Southern Homes would repair it, however this area of land is not owned by Southern Homes and they are not responsible for its maintenance.  

-  Mr. Rupp brought up the topic of the Fall Fun Fair.  He reminded everyone that we do not own the green spaces and therefore cannot host events on those areas until the dispute with Lonesome Development is resolved.  Businesses run out of homes are strictly prohibited by the covenants.  Social fairs and functions need to be approved by the board if the HOA is to be in any way involved.  Requests should be submitted prior to planning to receive approval.  

-  Guest Marty Dean was recognized by Mr. Rupp.  Mr. Dean is one of the councilmen for this area of St Tammany Parish.  Mr. Dean stated that he was vaguely aware of the situation regarding the ponds and took notes regarding the situation.  One of the homeowners brought up the brown water situation and said that they had been working with Greg Gordon.  Again Mr. Dean took notes and stated that he would look into it but that the homeowners should contact Kevin Davis' office, who as Parish President was the head of Tammany Utilities.  He recommended that a small group of TCHOA representatives contact his staff and set up a meeting to sit down and talk about issues.  He went on to discuss building along the 1085 corridor and possible new stores roundabouts in busy intersections.

-  Justin Williams, Robert Soule, and Kevin Kullivan were introduced by Mr. Rupp.  They will be candidates in the upcoming elections.  Each was given a chance to speak to those assembled.

The floor was open to discussion:

- A question was brought forth about the speed limit signs.  It was confirmed that 25 mph is the actual speed limit according to parish ordinance.  

-  There were concerns raised about dog waste left in neighbors' yards and a less than subtle to reminder to please pick up after your animal.

Joseph Rupp introduced himself to those assembled as the newly elected President of Tallow Creek Homeowners’ Association.    The minutes from the previous general meeting were read from the record. 

-           Jason Brown announced the new voice mail and P.O. Box system for the Homeowners’ Association.  There is no longer a box in the sales office.  All the new contact information is posted on the website.

 

-           The brown water issue that has been plaguing homeowners is due to work being conducted by Parish Water aka St Tammany Utilities.  They are flushing the water valves to re-circulate the system in a way that does not cause sediment to build and flow into the taps.  However the sediment is not hazardous.   An Adobe update on how to flush water heaters and dishwashers may be added to the Homeowners’ Association’s website.

 

-          The Architectural Control Committee is conducting inspections monthly.  Sheds that are not located at least ten feet from the fence lines will be cited.  This is a parish ordinance and as such cannot be granted a variance by the board.  Satellites dishes that are not placed on the back of residences will be also be cited.  It is recommended that when residents become aware of these issues that they report them to the board so that they can be followed up on.  Inspectors cannot see through or sometimes over fences or trespass on private property. 

 

-          Welcome packages will be put together for new homeowners with reminders regarding the covenants.  There has been many complaints that new homeowners are either unaware of or have not received copies of the covenants.  The Homeowners’ Association will work with Southern Homes sales office in order to get the information on new home closures.

 

-          A subdivision wide garage sale will be held on May 1, 2010.  It is yet to be determined whether or not a percentage of the proceeds of the garage sale earnings will be voluntarily donated to charity.  Other suggestions for coming events included a 4th of July Celebration and an Arbor Day Planting Event for the ponds.

 

-          Complaints regarding noisy neighbors need to be directed to the police.  Complaints regarding dogs and other animals need to be forwarded to animal control.  The Homeowners’ Association Board Members do not have the training or the manpower to break up parties or tackle rabid animals.  We can cite homeowner’s after a number of occurrences and complaints but the results are not immediate and do take time.  For more urgent needs please contact the proper authorities.

 

-          Traffic issues need to be directed to the Parish Road Crew.  Pot holes, yellow lines down the center of Tallow Creek, and the speed limit signs are all maintained by the parish and the Homeowners’ Association is not a liberty to change or alter any of it.  If you have crumbling curbs please contact the parish and make them aware of the problem.

 

-          Jim Martin presented the budget.  We are currently $11,000 under budget due to reduced costs of lawn care, late payments on dues, and people moving in to the subdivision.  These costs are being held in trust pending a resolution on the pond/green space issue.  Unfortunately the number of homes in default on dues has risen since last year from 51 to 92. 

 

-          Peter Claverie, past President of the Homeowners’ Association, was presented with a plaque and thanked for his service and dedication to Tallow Creek.

 

-          There are currently no plans to build a playground, running track, swimming pool, or any other leisure area in Tallow Creek Subdivision.  Any promises or suggestion made by Southern Homes at the time of home purchase were part of a sales pitch.

December 1, 2009

It was resolved that:

· Peter Claverie will not seek another term on the Board of the Tallow Creek Homeowners’ Association.

· Jim Martin was reelected as Treasurer of the Tallow Creek Homeowners’ Association by acclamation.

· Jason Brown was elected to the Tallow Creek Homeowners’ Association Board of Directors by acclamation and will serve the additional function as Web Master for Tallow Creek.

· Bill Wagner will serve the additional function as Architectural Control for Tallow Creek.

· Bill and Amy Wagner will serve the addition function as the Decorating Committee for Tallow Creek.

· The Tallow Creek Homeowners’ Association would like to thank members of the previous Decorating Committee for their time and efforts in beautifying our community and will be sending out letters to their members.

· No suggestions for any changes in the covenants were received within the time period allowed for consideration. 

Discussion:

The meeting began with general introductions. Peter Claverie announced that he will not be seeking another term as President of the HOA as he will be relocating. Jim Martin’s term, however, is ending and he is running for reelection as Treasurer. He introduced Jason Brown and gave Mr. Brown a chance to speak to those assembled.

Mr. Brown spoke for a few moments about his reasons for wanting to join the Board of Directors. Those reasons included wanting to maintain the family atmosphere of the community and to ensure that the property values were kept intact. He offered a request for any ideas that the community members might have.

Mr. Claverie went on to advise that no changes to the covenants were submitted in a timely manner and therefore none were up for consideration. Bill Wagner has volunteered to take over the Architectural Control for the community. Bill and Amy Wagner have volunteered to take over the Decorating Committee for the community. Jason Brown has volunteered to take over the Web Master position for the community.

Jim Martin submitted his financial report with a net profit. There are still five homeowners who are past due on their HOA dues. However, Mr. Martin stipulated that any profits made where set aside to pay for the insurance premiums that will come due when the green spaces transfer ownership which will happen shortly. Julie, our current CPA, has changed positions and is now working at Resource Bank but will continue to be the CPA for Tallow Creek Homeowners’ Association. When the letters for HOA dues go out at the beginning of the year, the new guidelines will be included on those letters.

Mr. Claverie then called for a vote for by acclamation for Mr. Martin as Treasurer of Tallow Creek Homeowners’ Association. Mr. Jim Martin was reelected as Treasurer by acclamation by those assembled. Mr. Claverie then called for a vote by acclamation for Mr. Brown as Board Member for Tallow Creek Homeowners’ Association. Mr. Jason Brown was elected by acclamation by those assembled.

The floor was then opened for questions and comments.

- No speed bumps will be allowed in the subdivision because of the possibility to damage to cars and since the streets technically belong to the Parish they have the final say.

- Marty Dean will introduce an ordinance to lower the speed limit in Tallow Creek to 15 MPH at the December meeting

- Pot holes and lines along the main entrance to Tallow Creek also fall under St. Tammany jurisdiction and the HOA is unable to make any changes to the streets because they do not belong to us. `

- The unused construction site at the back corner of Arian and Solomon turned into a junk heap; possibility that Southern Homes owns that lot. Peter will talk to Chris about the status of the lot.

- The HOA cannot stop building on nor afford to buy the lots along Tallow Creek Blvd entrance. They are owned by Lonesome Development, a separate company and are not considered green spaces.

- Because of the “Dark Skies” Laws the HOA is unable to alter the lighting in the back of the subdivision in any way. Additional lights would be costly, 12-15K a piece and would have very limited if any benefit.

Board Meeting

November 16, 2009

It was announced that:

· Peter Claverie will be stepping down as the President of the Homeowners’ Association as he will be relocating

· Act of Donation papers are pending completion from Lonesome Development at which time they will be turned over to Eric Bopp; the attorney for Tallow Creek HOA

· Jason Brown, a homeowner, has been nominated for the board and will be given a chance to speak at the next HOA general meeting.

 

Discussion:

The meeting began with Mr. Claverie informing the board members assembled that he would not be running for another term as HOA President as he was planning to sell his home in Tallow Creek and relocate to Memphis, TN. Jim Martin will continue to stay on the board as the Treasurer and will be up for reelection at the next general HOA meeting.

Other discussion included general updates and housekeeping regarding the subdivision.

The areas around the back ponds have been cleared of rubbish by Lonesome Development and the landscaping crew will have taken over maintenance there.

To date there are more than eleven homes in Tallow Creek that have been found to have Chinese Drywall. There is an unaffiliated informational meeting taking place on November 19th regarding the class action lawsuit for which the deadline is December 10th.

The large fence on the corner of Tallow Creek and J.J. is deemed within covenants as the owners have raised the level of the yard so that the fence is no longer taller than six feet.

We were reminded that any profit that we see from dues is essentially set aside for the payment of insurance premiums for the green spaces once the ownership is transferred to the HOA.

General Homeowners' Meeting

June 18, 2009

It was resolved that:

  • The Tallow Creek Homeowners' Association will support the Chinese drywall situation in Tallow Creek by acting as a "clearing house" for information obtained by its residents. This is the utmost support that we can provide since the Association is not involved in the building of the homes themselves.
  • An ordinance granting permission for Tallow Creek Subdivision to allow the speed limit to be 15 miles per hour is currently pending. Originally it was approved by a council man, someone complained and it was reverted to 25 miles per hour. Now the 15 miles per hour is awaiting approval.
  • Letters have been sent to twenty-six homeowners who are delinquent on their dues. These dues must be paid by July 6th or they will be sent to the attorney for legal action.
  • The ponds do not belong to the Homeowners' Association and therefore can not be policed by them. The Association does strongly discourage use of the ponds as there have been rumors of hazardous wildlife (snakes, alligators) around the pond areas. We ask that all parents be aware and responsible for their children's behavior around these areas.
  • Peter Claverie will be working with officials at St. Tammany Parish to see what can be done to speed up work that needs to be done on the ponds in order for them to come into environmental compliance with St. Tammany regulations. Members of the community will be organizing a call-in/email campaign to address this specific issue.
  • Peter Claverie will be contacting Mr. Henning regarding clean up of debris and access to the back pond near Solomon and Amy. Once this area has been cleared and access granted our landscapers can maintain it.
  • Beginning July 1st, the Board of Directors will kick off regular routine inspections of the neighborhood looking for covenant infractions. Violators will receive three warnings to come into compliance and then be fined $25 a day.

 

 

Discussion:

The meeting began with general introductions. Mr. Claverie announced that Chinese drywall had been found in at least of the homes in Tallow Creek. Another couple at the meeting stated that they had found Chinese drywall in their home as well. Grady Flatman, that man who had sent a letter informing the Board of the Chinese drywall in his home, asked to speak.

Mr. Flatman told the group of his experiences, giving some helpful information on what to look for when trying to locate Chinese drywall. Specifically, he indicated the copper wiring had been blackened, that air conditioning coils had repeatedly been ruined, and that the drywall was clearly marked. He encouraged others to seek the advice of attorney regarding their legal rights. Mr. Claverie also added that air conditioning issues, in and of itself, was not an indication that there was Chinese drywall.

Jim Martin presented the financial report. We are currently $5000 under budget. Much of that is due to an increase in the sale of homes in Tallow Creek. Once more of the green spaces are turned over to us and we have to insure and landscape them, that surplus will no longer exist.

Frank Fury, a Deacon at the Presbyterian Church, welcomed us and invited us to some events at the church. These included a Gospel Circle every 3rd Tuesday and a Free Movie Night every 3rd Friday.

Mr. Claverie stipulated that there are currently no covenants or restrictions of use in the ponds. Further, the Homeowners' Association does not own the ponds. We are unable to be responsible for those who choose to use them, though we strongly discourage it.

Many residents were upset that the compliance issues regarding the ponds were taking so long. Mr. Claverie will be working with St. Tammany Parish officials to see what can be done to force Mr. Henning to complete repairs of these ponds so that they are in environment compliance. Many residents wished to organize a call-in/email campaign and propose to do so. The details of such campaign were not forthcoming at the time of this meeting.

Mr. Claverie stated that the back ponds will be maintained by our Associations' landscapers once the initial debris cleanup is done and permanent access is granted by Lonesome Development. So far, neither one of these issues has been taken care of. Mr. Claverie will contact Lonesome Development to see if he can speed up a resolution of this matter.

Mr. Claverie announced that the decoration committee has disbanded and thanked them for their service. We are currently looking for volunteers for this committee.

A group of residents were there to complain about a fence that had been built on a house that faces one of the front ponds. The homeowner had received permission for the Architectural Committee to build a six foot cedar fence rather than the four foot picket fence. Mr. Claverie will mediate the current dispute between the neighbors and the resident with the fence.

There are no restrictions on having rental properties in Tallow Creek Subdivision. Nor does the Board of Directors ever see such covenant passing in the future.

Scooters are no allowed at all in the subdivision.

Home Depot does have a builder who can build sheds according to the covenants but they do not have a brochure for this specific type of shed.

Nominations for the Office of Treasurer will be announced in October. Jim Martin will run again as his three year term is up. If no one else is nominated then the vote will be by voice acclamation in that meeting in October.

The plans for playground have been temporarily sidelined due to the situation with the economy. They will resume when things have improved.

Mr. Claverie motioned for the end of the meeting, which was seconded at 9:03 PM.

It was resolved that:

  • In lieu of hiring a management company the HOA Board will start inspecting the neighborhood monthly for covenant violations starting on July 1st.
  • In the matter of a non-vote equals a no vote, the subject has been set aside for future decision when it is deemed necessary to change the bylaw and all board members are present to be heard from.
  • Those who currently owe on their HOA fees will be turned over to the attorney for legal action on July 9th. The exception to this is those who only owe the $25 late fee. They will receive a collection letter instead from Mr. Claverie.
  • A letter will be sent to Mr. Grady Flatman residing at 816 Cole Court approving the parking of a dumpster in his driveway while he is having Chinese drywall removed from his home.
  • Homeowners' Association General Meetings will be curtailed to three a year instead of quarterly.

It was resolved that:

  • The Board of Directors will pursue a fact finding mission on creating a lighting district in Tallow Creek subdivision based on the interest of the homeowners who attended the meeting.
  • Bill Wagner will continue to investigate options on garbage companies willing to provide services for the whole of Tallow Creek in the hopes that this will provide less costly, more efficient services for the residents.
  • The Board of Directors will turn down the offer presented to them by Southern Homes to purchase the Sales Office/Design Center after the homeowners overwhelmingly supported the idea.
  • The Board of Directors will move forward to develop a preliminary proposal regarding the purchase and development of available lots in the subdivision into a common recreational/playground area after the majority of residents supported the idea.

Updates—

Ponds- Kate Wilhem- St.T. Parish engineering is

reviewing the report and following through with the

accurate information the Board gave them. They

will be checking permits for compliance and

problems. The HOA will not accept ownership of the

ponds unless they are up to code.

Arian Lane Drainage-homeowners

-homeowners brought it to the attention of the Board

that their drains are clogged (probably from the

construction washing the mud off to go down the drains). Water backed up halfway up their drives during a big rain last week. They were directed to contact the St.T. Parish Engineering Erosion and Sediment control department.

Discussed changes to the Covenants—Homeowners and Board

-proposed change requiring a written, official vote to

increase dues (when necessary—nothing pending) and

to receive ownership of the ponds, etc.

-Some homeowners want to draft a proposal to change

the current regulations for sheds.

-all proposals need to be submitted in writing for a vote that requires 75% of the homeowners to cast a vote, in accordance with the current convenants.

-green spaces are for all residents to use, be courtesy, contact Board (later street captains) for organized use.

Covington Food Bank—Lisa King

-Covington Food Bank is in desperate need of food. The HOA supports this cause by asking homeowners to make donations (food or cash) to them.

Hospitality—National Night Out—Miss Gigi

-August 5 from 7-9 p.m. there will be a celebration in

the green space on Moore. Please walk, if you must

drive park on another street as there will be no parking

on Moore. There will be games for the kids and

information about keeping the neighborhood safe.

Please bring a snack to share, a donation for the food

bank, a lawn chair (if desired).

Open Floor-

-A path to the Y is not currently possible as the land

between them and us is private property.

-Unpaid dues are being pursued through legal avenues.

-More discussion about change the covenants esp. sheds.

-Pot hole and rut at entrance have gotten worse

-Request that all street lights be glass as the coned

  1. Pond Status Report-Jim Stagge presented a report about his company's success and proposal to help with 4 Tallow Creek ponds.
  2. $2000-$3000 will finance an "Inventory of Existing Conditions." Motion to approved set forth by Peter Claverie and seconded by Anne Klein. Motion carried. Kate Wilhelm will not vote as it is her company that we are using.

  3. Warranty issues were discussed. It was decided that we would look into legal avenues to address Southern Homes failure to act on work orders. Anne Klein will pursue this.
  4. Failure to Follow Covenants-Peter Claverie and Jim Martin have acquired previous request by residence. They will review them, survey the neighborhood and put notices on doors of those out of compliance. The RV and shed on Arian Lane will be notified to comply immediately by Peter Claverie.
  5. Green Space Usage-There are no current plans for a playground or pool. This will be reviewed when clubhouse is turned over to the HOA.

  6. Speed Bumps-Marty Dean will address this at the 1/15/2008 HOA meeting.
  7. Dogs-Leash laws exist in the parish as do laws about cleaning up after them. This is also covered in the covenants. Owners should notify the animal control and/or sheriff's department when they see these things occur. Marty Dean will address this further at the 1/15/2008 HOA meeting.

  8. Lighting-When does the parish take over.
  9. Gated Community Question-Parish will not cover streets resulting in increased dues.

  10. Changes to covenants proposed:
    1. Board structure should increase to 9 members who are elected to serve in 3-year increments. This will be done on a rotating basis to avoid a whole new board taking office. 3 members will be elected at a time for a 3-year term. Only 2 consecutive terms may be served. The chairman will be elected for 1-year terms with a 2 term maximum.
    2. Garbage can covenant changed to the side instead of "out of sight."

Orders of Business

  1. Board members, Home Owners and Jim Stagge introduce themselves.
  2. Announcement of the change in the number of meetings from 1 per year to 4 per year.
  3. Mr. Claverie announced a breakthrough with Southern Homes Warranty. Mr. Chris Kornman, President of Southern Homes, will address issues that have been ignored. Residents with warranty matters that need to be addressed should stop by the front office to fill out a form and place it in the drop box. Mr. Claverie, who will serve as a liaison between the homeowners and Southern Homes, will forward these.
  4. Arian Lane mud will be moved as soon as the weather allows.
  5. Pond Restoration Plan-Jim Stagge presented his companies success with pond restoration. He also presented the "Inventory of Existing Conditions" and that the board had approved up to $3000 from the HOA dues to identify the problems (causes of erosion, stabilization and beautification) and suggest solutions. Homeowners asked question about this wondering about the financial responsibility of Southern Homes and Tim Henning of Lonesome Development. A disclosure was made that this is Kate Wilhelm's company. She will not be voting on this issue. Members were invited to ask Mr. Stagge questions after the meeting.
  6. Marty Dean, Councilman for our district (District 1) attended this meeting. There is a parish-wide problem with pond drainage. He stated that this district is growing exponentially. He also stated that parish funds were being earmarked for our district.
    1. Mr. Martin pointed out problems in Tallow Creek with the curbs. Mr. Dean will check into jurisdiction of the streets and curbs.
    2. Mr. Claverie brought up the idea of speed bumps. Mr. Dean said that the parish is not supportive of them because of the potential lawsuits. The signs in Timber Branch have not helped their speeding problems. Solutions will be considered and presented at a later date.
    3. Mr. Dean reviewed new access roads for highways 21, 12 and 1085.
    4. Leash laws exist in the parish. Mr. Dean stated that residents should contact the sheriff's office or animal control. He also reported that this is another problem throughout our district as the transition from country to more urban has happened so quickly.
  7. Kate W brought up possible changes to covenants.

  2. Jim Martin presented the budget. He brought up the following points:
    1. Current landscaping is too expensive and inconsistent. He suggested that homeowners with licensed and bonded landscaping businesses should put in a bid. The HOA is eager to find a less expensive and more dependable service company.
    2. Postage expense may be less.
    3. Repairs and Maintenance Expense is anticipatory.
    4. Utility expense is for streetlights and pumps.
    5. He addressed the complaints that the dues are too high.

Meeting was adjourned. Board members, Mr. Dean and Jim Stagge remained to answer questions.

Lisa King met with the primary members of the Hospitality Committee to discuss plans for an association Easter activity.
